Ozark Timber warrants to the original purchaser the replacement, free of charge, of any wood fencing component manufactured by Ozark Timber that fails within 25 years from the date of original purchase due to decay or insects EXCEPT failure resulting from the effect of salt water, failure resulting from any use of the wood pickets, and EXCEPT for failure resulting from any use of the wood fencing component in a manner not intended. In all cases, the purchaser must pay (1) all transportation costs from our plant in St. Joe, Arkansas, and (2) all installations costs.
Ozark Timber does not authorize any person to create for it any other obligation or liability in connection with its products.
This warranty must be completed and the attached Owner Registration Card must be completed and mailed to Ozark Timber, St. Joe, Arkansas 72675, within 30 days after the installation before this warranty is effective.
Written notice of failure covered by this warranty shall be mailed by the original purchaser to Ozark Timber, St. Joe, Arkansas 72675, and the fencing components claimed to have failed must be available at the place of installation for inspection on behalf of Ozark Timber for the purpose of determining where the claimed failure is covered by this warranty.
Ozark Timber shall not be liable for consequential commercial damages resulting from breach of this written warranty or any implied warranty.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights which vary state to state.
